What Happens After We Receive a Notice?
When we receive a copyright infringement notice that substantially satisfies applicable DMCA requirements, we may review the identified material and take appropriate action.
Where required or appropriate, this may include removing or disabling access to the material claimed to be infringing.
We may also notify the person responsible for the affected material and provide them with information about the copyright complaint so that they have an opportunity to respond.
Scheduloom reserves the right to remove or restrict access to content when we reasonably believe that doing so is necessary to comply with applicable copyright law, our policies, or a valid legal request.
Counter-Notification
If material that you submitted or made available through Scheduloom has been removed or disabled because of a copyright complaint and you believe the removal resulted from a mistake or misidentification, you may submit a written counter-notification.
Your counter-notification should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled.
- The location or URL where the material appeared before it was removed or access was disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification.
- Your full name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. §512(g), including, where applicable, the judicial district in which the service provider may be found if you are located outside the United States.
- A statement that you will accept service of process from the person who submitted the original copyright infringement notification or that person’s authorized agent.
Counter-notifications should be sent to the same DMCA contact listed above.
Restoration of Material
After receiving a valid counter-notification, we may forward a copy to the person who submitted the original copyright complaint.
Where the DMCA counter-notification procedure applies, material may be restored in accordance with the time periods and requirements established under applicable law unless the original complaining party informs us that they have filed a court action seeking to prevent restoration of the material.
Repeat Copyright Infringement
Scheduloom does not tolerate repeated copyright infringement.
Where appropriate and technically applicable, we may restrict, suspend, or terminate access to our services for users or parties who repeatedly infringe the copyrights or other intellectual property rights of others.
We may consider the circumstances surrounding each complaint when determining what action is appropriate.
Misrepresentation
Please make sure that any DMCA notice or counter-notification you submit is accurate.
Knowingly making material misrepresentations regarding whether content is infringing or whether content was removed by mistake may result in legal consequences under applicable law.
If you are uncertain whether particular material infringes your copyright, you may wish to obtain independent legal advice before submitting a DMCA notice.
Third-Party Content and Links
Scheduloom may contain links to third-party websites, resources, tools, or services.
We do not control third-party websites and are not responsible for content hosted independently by third parties.
If allegedly infringing material is hosted on another website rather than on Scheduloom, you may need to contact the operator or hosting provider of that website directly.
No Waiver of Rights
Nothing in this DMCA Policy constitutes a waiver of any rights, remedies, limitations, defenses, or protections available to Scheduloom under applicable copyright law.
We reserve all rights available under applicable laws and regulations.
